This Privacy Policy explains how Fish Audio collects, uses, shares and keeps information in connection with Dropline. "Dropline" means the Dropline apps and software on any device or platform we offer them on (today the Mac app and the Dropline Pinyin input method; other devices and platforms, such as mobile, may follow), the online services behind them, and the website dropline.fish.audio. By using Dropline, you agree to this policy. If you do not agree with it, do not use Dropline.
1. Who we are and how this policy fits with Fish Audio's
Dropline is a Fish Audio product. "Fish Audio", "we", "us" and "our" mean Hanabi AI Inc., a Delaware corporation that does business as Fish Audio. Where data protection law uses the term, Hanabi AI Inc. is the controller of the personal information this policy describes.
- Registered address: Hanabi AI Inc., 1111B S Governors Ave STE 48109, Dover, DE 19904, United States
- Mailing address: Hanabi AI Inc. (Fish Audio), 195 Page Mill Rd #107, Palo Alto, CA 94306, United States
You use Dropline with a Fish Audio account. The Fish Audio Privacy Policy covers that account and Fish Audio's other products, websites and services, including the pages where you sign in and the cookies and other tools those pages use. This policy adds to the Fish Audio Privacy Policy for Dropline. Where the two differ about Dropline, this policy applies.
The Dropline Terms of Service also apply to your use of Dropline, including their limits on our liability and their terms on disputes.
If your organization has a Dropline Customer Agreement with us, meaning a separate written agreement for Dropline between the organization and us, that agreement prevails over this policy for the organization's users where the two differ. An agreement for the Fish Audio platform does not apply to Dropline unless it says so.
Dropline changes over time. This policy applies wherever we make Dropline available, and to new and changed features, apps, platforms and services, unless we say otherwise when we introduce them.
2. Information we collect
We collect information that you provide, information that Dropline reads or generates when you use it, and information from other sources. What we collect depends on the features you use and on your settings and permissions. It includes the following.
- Account information. Information from your Fish Audio account, such as your name, email address, profile picture, account and team details, and sign-in credentials.
- Voice recordings. The audio Dropline records when you dictate or edit by voice, including any other voices and sounds it picks up.
- Text and other content from your apps and screen. Dropline reads text and other content from the app you are using and from your screen, such as the text near your cursor, text you have selected, window and page titles, web addresses and visible text. It does this for purposes such as giving context to a dictation or an edit and, at other times while Dropline is running, learning the names and terms you use.
- Your dictionary. The names, words and phrases in your personal dictionary, including those you add, those you import from other apps or from your contacts, and those Dropline learns for you.
- What you type. Information about what you type with a Dropline keyboard or input method, such as Dropline Pinyin. Examples are your keystrokes, the suggestions shown and chosen, the text entered, and nearby text.
- Results. The text and other results Dropline produces for you.
- Device, app, usage and diagnostic information. Information about your device and about how Dropline is used and performs, such as device and operating system details, the name on your device's user account, language, region and time settings, app version, identifiers, your Dropline settings, the apps you use Dropline in, the features you use and when, logs, performance data, error and crash reports, any additional diagnostics you choose to send us, and your IP address.
- Approximate location. Your approximate location, such as your country, which we derive from your IP address, including through a third-party lookup service, and from your device's settings.
- Communications. What you send us when you contact us, ask for support, give feedback or answer a survey.
- Website information. When you visit our website, information such as your IP address, browser and device details, the pages you view and your preferences, which we and our providers may collect using cookies and similar technologies.
- Information from other sources. Information from Fish Audio's other products and services, from our service providers and partners, and from other sources where the law allows.
- Other information. Any other information you provide or that is generated when you use Dropline.
When you dictate or edit by voice, we process your audio together with information that helps produce accurate text, such as your personal dictionary, text and other content from the app you are using and from your screen, and related information about you, your device and your request.
When you type, Dropline generally works out its suggestions on your device. Depending on your settings, records of what you type and related content are also sent to us (section 4).
On your device. Dropline also stores and processes information on your device, such as your dictionary, your settings, typing suggestions and history, content it has read to learn your vocabulary, and your clipboard when Dropline pastes for you. Some of that information is sent to us as this policy describes. For example, your dictionary is sent with your dictations.
Password and secure fields. Dropline does not read or record in password fields or other secure input fields that your operating system reports to it.
Other people's information and sensitive information. What you say, type and have on your screen can include information about other people and information that is sensitive. You decide what you use Dropline with, and you are responsible for having the right to share it with us.
3. How we use information
We use the information we collect to:
- provide, operate and maintain Dropline, including to turn speech into text, to write, rewrite and format text, to suggest and enter what you type, to fit results to your vocabulary and context, and to manage your account and settings;
- secure, troubleshoot, test, measure and analyze Dropline, and detect, prevent and investigate fraud, abuse and misuse;
- research, develop and improve Dropline and Fish Audio's other products, services, technology and models, which includes training and evaluating AI models as your training choice allows (section 4);
- communicate with you, including about your account, updates, security and support and, where the law allows, about products and features that may interest you;
- comply with the law and with legal process, enforce our terms and policies, and protect the rights, property and safety of Fish Audio, our users and others; and
- carry out other purposes that we describe when we collect the information or that you agree to.
We may combine information from different sources. We process it with automated systems and with the help of people who work for us and for our service providers.
Aggregated and de-identified information. We may create aggregated, de-identified or anonymized information from the information we collect. Where that information no longer identifies you, we may use and share it for any lawful purpose, without restriction. We keep de-identified information in de-identified form and do not try to re-identify it, except as the law allows.
4. Your training choice
Dropline has a setting called "Help improve Dropline".
What it does. While the setting is on, we may keep what you say and type with Dropline, together with related content such as the context and the dictionary sent with it, the text Dropline produced, and related technical and usage information. We use it to train, evaluate and improve the models and technology behind Dropline and Fish Audio's other products and services. Authorized personnel and service providers may access and review it, including by listening to recordings and reading text.
Where it starts. The setting is on by default. Where we detect that you are in Europe (the European Economic Area, the United Kingdom or Switzerland) when you set up Dropline, it starts off. Detection relies on information such as your IP address and will not always be right, so check the setting if this matters to you.
How to change it. You can turn the setting on or off at any time in Dropline's settings.
If you turn it off. We stop keeping new data for training, and we promptly delete the data we kept for training. Copies in backups and other systems clear within a reasonable period. Models that were already trained or improved are not retrained, and we may continue to use them. Turning the setting off does not affect aggregated or de-identified information, or information we keep for the other purposes in this policy, such as the record of your choice. We continue to process what you say and type in order to provide Dropline to you.
How long we keep it. We keep data saved for training for up to 24 months, unless you turn the setting off sooner. Reviewers' notes and annotations, models, and aggregated or de-identified information derived from that data may be kept for longer.
Content you do not want kept. We may use automated measures to try to leave some sensitive content out of what we keep for training, but they do not cover everything and you should not rely on them. If you work with content that should not be kept, including where your organization's rules do not allow it, turn the setting off.
5. How we share information
We share information with:
- Service providers and partners that process it for us or help us provide Dropline, such as cloud hosting and infrastructure, AI model, database, analytics, error-reporting, communications and support providers. For example, when you dictate, your audio and related content go to AI model providers that help produce your text. The providers we use may change over time.
- Affiliates, meaning companies that control us, that we control or that are under common control with us, and Fish Audio's other products and services.
- Your team or organization. If you use Dropline with a team or through an organization, its administrators may receive information about your account and your use of Dropline.
- Professional advisers, such as lawyers, auditors and insurers.
- Authorities and other parties, where we believe that disclosure is required or permitted by law or legal process, or is reasonably necessary to enforce our terms, to investigate misuse, or to protect the rights, property and safety of Fish Audio, our users or others.
- Successors. A buyer, successor or other party in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business or assets, including while such a transaction is being considered.
- Anyone else, at your direction or with your consent.
Some providers handle information under their own terms and may keep it for a limited time, for example to detect abuse. Where an AI model provider offers the choice, we ask it not to use your content to train its own models.
We do not sell the personal information we collect through Dropline, and we do not share it for cross-context behavioral advertising or use it for targeted advertising. The Fish Audio Privacy Policy describes the practices of Fish Audio's websites, including the pages where you sign in.
6. How long we keep information
We keep information for as long as needed for the purposes in this policy, unless a longer period is required or permitted by law. How long depends on things such as the kind of information, why we have it, your settings, and our legal, security and business needs. For example:
- data saved for training is kept as section 4 describes;
- what you say and type that is not saved for training is generally kept only for as long as we need it to provide, secure and troubleshoot Dropline;
- account, usage and diagnostic information is kept for as long as we need it to run, secure and improve Dropline.
We may keep information for longer where we need it to comply with legal obligations, resolve disputes, enforce our agreements, keep Dropline secure or prevent abuse, or for other legitimate business reasons. Copies may remain in backups and in our providers' systems for a limited time. Information stored on your device remains there until you or Dropline delete it, and removing the app may not remove all of it.
7. Your choices
- Training. You can change your training choice at any time (section 4).
- Permissions and settings. You control what Dropline can access through your device's permissions, such as microphone and accessibility access, and through Dropline's settings. Dropline uses these permissions to, for example, record your voice, detect its shortcut, read content as section 2 describes and enter text for you. Some features do not work without them. On other platforms Dropline may ask for the equivalent permissions, and it processes the same kinds of information.
- Your dictionary. You can review, edit and delete the entries in your dictionary in Dropline's settings.
- Deletion. You can ask us to delete information we hold about you (section 11). Closing your Fish Audio account may not by itself delete information that Dropline keeps, so turn off "Help improve Dropline" or contact us as well.
- Messages from us. You can opt out of promotional messages by following the instructions in them. We may still send you messages about your account and the service.
- Stopping. You can stop using Dropline at any time by signing out and removing it from your device.
8. Where information is processed
Fish Audio is based in the United States. We and our service providers process and store information in the United States and in other countries where we or they operate. The laws of those countries may protect information differently from the laws where you live. By using Dropline, you understand that your information is transferred to and processed in those countries. Where the law that applies to you requires safeguards for such transfers, we use transfer mechanisms that the law recognizes, which may include standard contractual clauses.
9. Security
We take reasonable technical and organizational measures to protect the information we hold from loss, misuse and unauthorized access. No system is perfectly secure, and we cannot guarantee the security of your information. You are responsible for keeping your device and your account secure. Information that Dropline stores on your device may be accessible to other people and software with access to that device.
10. Children
Dropline is not directed to children, and you must be at least 16 to use it. We do not knowingly collect personal information from children under 16. If you believe a child under 16 has given us personal information, contact us and we will take steps to delete it.
11. Your privacy rights
Depending on where you live, the law may give you rights over your personal information, such as the right to access it, correct it, delete it or receive a copy of it, to object to or restrict certain uses of it, and to withdraw a consent. These rights are not absolute, and we handle each request as the law that applies to you requires.
How to make a request. Write to support@fish.audio from the email address on your Fish Audio account, or send your request by mail to the mailing address in section 13. For data saved for training, you can also turn off "Help improve Dropline" (section 4). We may need to verify your identity and may ask you for more information before we act. Where the law allows it, an authorized agent may make a request for you, and we may ask for proof of their authority. We respond within the time the law allows, and we may decline or limit a request where the law permits. We do not discriminate against you for using your rights.
Appeals. If we decline your request and the law gives you a right to appeal, send your appeal by mail to the mailing address in section 13. Describe your request and say why you disagree with our decision.
Your Fish Audio account. For requests about your Fish Audio account, see the Fish Audio Privacy Policy.
11.1 European Economic Area, United Kingdom and Switzerland
Legal bases. We process personal information on these bases: to perform our contract with you, which covers providing Dropline and its features; your consent, where the law requires it, for example for keeping your data to train models, which you can withdraw at any time without affecting what was done before; our legitimate interests, where your rights do not override them, such as securing, analyzing, improving and developing our products, services and models, communicating with you and protecting our rights; and compliance with our legal obligations. Some information is needed to provide Dropline, and Dropline may not work without it. Keeping your data for training is optional.
Your rights. Subject to the conditions and exceptions in the law, you may ask us for access to your personal information, ask us to correct or delete it, ask us to restrict our processing of it or object to that processing, ask to receive it in a portable form, and withdraw a consent you have given. You may have the right to lodge a complaint with a data protection authority.
11.2 United States
Some US states give their residents additional privacy rights. This section applies to you if you live in one of those states, to the extent its law applies to us.
What we collect and why. In the terms those laws use, the categories of personal information we collect, and have collected in the past 12 months, are identifiers; audio information; internet or other electronic network activity information; approximate geolocation; the content of what you dictate, type and have on your screen, which may include sensitive personal information; and the other information section 2 describes. We collect it from you, from your device and from the other sources in section 2. We use it for the purposes in section 3, disclose it to the recipients in section 5, and keep it as section 6 describes.
No sale and no targeted advertising. We do not sell the personal information we collect through Dropline. We do not share it for cross-context behavioral advertising or process it for targeted advertising, as those laws define these terms, and we do not use it to profile you for decisions that have legal or similarly significant effects. We use sensitive personal information for the purposes in this policy and not to infer characteristics about you. Dropline does not respond to "Do Not Track" browser signals.
Your rights. Depending on your state and subject to exceptions, you may have the right to know what personal information we hold about you and how we use and disclose it, to receive a copy of it, to correct it and to delete it. Section 11 explains how to make a request and how to appeal.
12. Changes to this policy
We may update this policy at any time by posting the updated version on this page and changing the date at the top. An update takes effect when it is posted, unless we say otherwise. Where the law requires it, we will tell you about an update or ask for your consent. If you keep using Dropline after an update takes effect, you accept the updated policy.
